Santa Cruz, Ca. — Today we gather in protest. Today we gather<\/span><\/div>\n
to use first amendment rights that will be seriously curtailed<\/a><\/span><\/div>\n
in a little over a month under the pretense of “public safety.”<\/span><\/div>\n
<\/div>\n
Next month, we will likely lose vast areas of public space<\/span><\/div>\n
greatly limiting our right to speak, to set up a political table,<\/span><\/div>\n
to circulate several petitions at once,\u00a0our right to\u00a0seek redress of government<\/span><\/div>\n
grievances, and our right to peaceably assemble in the center of<\/span><\/div>\n
our\u00a0community.<\/span><\/div>\n
<\/div>\n
\u00a0For years, the City of Santa Cruz, at the urging of the Downtown Association<\/span><\/div>\n
and carried out by the Santa Cruz Police Department, has continuously violated<\/span><\/div>\n
the rights of artists & musicians to display & sell their works of art in a public<\/span><\/div>\n
space. A pushback was made right here on Pacific Ave. by recording artist<\/span><\/div>\n
& street performer, Mike True, who challenged his citation for displaying<\/span><\/div>\n
his CD’s for sale on Pacific Ave. in court. He won. <\/span><\/div>\n
<\/div>\n
Later, his case & others recently won a further victory which unambiguously<\/span><\/div>\n
asserts that artists, writers, and musicians can display their works of art in public<\/span><\/div>\n
spaces without the need for any kind of permit.<\/span><\/div>\n
<\/div>\n
As you know, all rights are subject to time, place, and manner restrictions if<\/span><\/div>\n
the State, in this case the government of the City of Santa Cruz, can prove their<\/span><\/div>\n
is an overwhelming public health or safety hazard that justifies it.<\/span><\/div>\n
<\/div>\n
Make no mistake, the public safety “emergency” that is so horrible that<\/span><\/div>\n
Councilmembers Cynthia Mathews and David Terrazas have ordered our<\/span><\/div>\n
government to limit the rights & freedoms of the citizens of Santa Cruz<\/span><\/div>\n
to exercise our first amendment rights, is to continue to prevent<\/span><\/div>\n
artists & musicians & political tablers to exercise our LEGAL, PROTECTED<\/span><\/div>\n
first amendment rights.<\/span><\/div>\n
<\/div>\n
The “emergency” is that artists & musicians now have the LEGAL, PROTECTED<\/span><\/div>\n
right to display their art or music. The HORROR!!!!<\/span><\/div>\n
<\/div>\n
People, this is about greed and hate, nothing else. A phony “trip-fall” hazard<\/span><\/div>\n
was presented to urge the banning of blankets, tarps & ARTISTs.<\/span><\/div>\n
<\/div>\n
The ordinance which bans PEOPLE who are presenting art, performing music,<\/span><\/div>\n
or political tables protects trash cans, fences, and statues! <\/span><\/div>\n
<\/div>\n
Please stop this backlash against the color and character of our community.<\/span><\/div>\n
Don’t make Santa Cruz the City known for “Sing a song, go to Jail”<\/span><\/div>\n
“Show a painting, go to jail” or “smoke a cigarette go to jail.”<\/span><\/div>\n
<\/div>\n
Protect your first amendment….by using it.<\/span><\/div>\n
<\/div>\n
Thank-you.<\/span><\/div>\n

Our right to exhibit art or literature, with price tags<\/span><\/div>\n
