{"id":1917,"date":"2015-04-07T02:43:44","date_gmt":"2015-04-07T02:43:44","guid":{"rendered":"http:\/\/huffsantacruz.org\/wordpress\/?p=1917"},"modified":"2015-04-07T02:43:44","modified_gmt":"2015-04-07T02:43:44","slug":"back-and-forth-battle-in-sacramento-on-right-to-rest-law","status":"publish","type":"post","link":"https:\/\/huffsantacruz.org\/wordpress\/back-and-forth-battle-in-sacramento-on-right-to-rest-law\/","title":{"rendered":"Back and Forth Battle in Sacramento on Right to Rest Law"},"content":{"rendered":"<div>\n<div>\n<div>\n<p>&nbsp;<\/p>\n<div dir=\"ltr\">NOTE BY NORSE:\u00a0 HUFF (Homeless United for Friendship &amp; Freedom) has endorsed the Right to Rest law currently up for a vote <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_577911431\"><span class=\"aQJ\">tomorrow<\/span><\/span> in the state Senate Transportation and Housing Committee.\u00a0 The Bill can be viewed at <a href=\"http:\/\/wraphome.org\/work\/civil-rights-campaign\" target=\"_blank\">http:\/\/wraphome.org\/work\/<wbr \/>civil-rights-campaign<\/a>\u00a0 along with info on campaigns in Colorado and Oregon.\u00a0 Protesters will be lobbying the Senate committee <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_577911432\"><span class=\"aQJ\">tomorrow<\/span><\/span> in Sacramento.<br \/>\nHUFF members have asked Santa Cruz City Councilmember Micah Posner to sponsor a local Right to Rest law, which he&#8217;s asked for more info on.\u00a0 Meanwhile Parks and Recreation and SCPD continue to ticket at a merry pace around &#8220;illegal&#8221; sleeping (i.e. outside at night) and being in a park after dark.\u00a0 The only walk-in emergency shelter in Santa Cruz will close in mid-April.\u00a0 The Homeless (Lack of) Services Center [HLOSC] still fails to give each person that signs up on the Waiting List for the Pall Lee loft and\/or the River St. mini-Shelter a copy of their accepted application, indicating they are on the list and so exempt from camping citations under MC 6.36.055.\u00a0 Reports of prison-like conditions at the HLOSC with the new &#8220;security fencing&#8221; and &#8220;ID card&#8221; systems are becoming more regular.<br \/>\nOn the positive side, there has been no reports yet of &#8220;stay-away&#8221; orders being given by cops, after an infraction ticket, for more than a day.\u00a0 On the negative side, virtually all infractions given out to Parks and Rec in the last few months have been given to apparently homeless people for non-crime crimes (as mentioned above) and regular stay-away-for-a-day orders with each citation.<br \/>\nSome of the audio [very choppy because of broadcast problems] from last Tuesday&#8217;s\u00a0 &#8220;Big John&#8221; watch, involving discussion of First Alarm Security Guared harassment of homeless people around the Public Library was played last night on Free Radio Santa Cruz at <a href=\"http:\/\/radiolibre.org\/brb\/brb150405.mp3\" target=\"_blank\">http:\/\/radiolibre.org\/brb\/<wbr \/>brb150405.mp3<\/a> [2 hours and 20 minutes into the audio file].\u00a0 I hope to rebroadcast and repost a more audible and coherent version in the near future.\u00a0\u00a0 <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_577911433\"><span class=\"aQJ\">Tomorrow&#8217;s<\/span><\/span> planned follow-up action in front of the main Public Library in Santa Cruz at <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_577911434\"><span class=\"aQJ\">9:30 AM<\/span><\/span> may be cancelled for rain.<br \/>\nHUFF will be meeting <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_577911435\"><span class=\"aQJ\">Wednesday<\/span><\/span>&#8211;with items on the agenda including demands that police abandon selective enforcement of the &#8220;nuisance&#8221; ordinances against the homeless, suspend or eliminate all use of tasers, shoot-to-kill directives, choke holds, CS gas, and other abusive practices.\u00a0 Reliable reports that cops confronted two Food Not Bombs activists with drawn guns at a private home in what seemed another example of &#8220;normal&#8221; over-reaction by police. The SCPD may feel empowered by hubbub the SCPD and supporters continue to exploit around the now two-year old deaths of homeless-hostile cops Loren Butchie Baker and Elizabeth Butler.\u00a0 A complassant City Council which recently voted down an attempt to return the BEARCAT armored personnel carrier &#8220;rescue&#8221; vehicle.\u00a0 The City Council Public Safety Committee meeting has declined to hold hearings on the verified stats showing class profiling by police especially in the downtown and park areas as well as race profiling by Officer Bradly Barnett.<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">Rebuttal to League of California Cities &#8211; Inrecent<\/span>years, there have been increases in the numbers people experiencing homelessness.<\/p>\n<p><span style=\"font-size: 12.5pt; font-family: Cambria,serif;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">Homelessness not only has grave human consequences, it also creates challenges for local governments,bothruralandurban.Accordingtoa2011reportbytheU.S.ConferenceofMayors, mostcitiescontinuedtoseeincreasesinhomelessnessdespitetherecoveringeconomyandreport thatpeopleexperiencinghomelessnessweredifficulttoserve.<span style=\"font-size: 8.0pt;\">2\u00a0\u00a0 \u00a0<\/span>Thereportfoundthat:<\/p>\n<p><span style=\"font-size: 12.5pt; font-family: Cambria,serif;\">\u00a0<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">\u00b7<span style=\"font-style: normal; font-variant: normal; font-weight: normal; font-size: 7pt; font-family: 'Times New Roman';\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span><\/span><span style=\"font-size: 12pt; font-family: Cambria,serif;\">Among households with and without children, unemployment led the list of causesof<\/span><span style=\"font-size: 12pt; font-family: Cambria,serif;\">homelessness cited by city officials. Homeless shelters are virtually nonexistent in rural communities and most health and socialservices accessible to indigent persons are located in areas with larger and denser populations.<\/p>\n<p><span style=\"font-size: 12.5pt; font-family: Cambria,serif;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">Families with children have been one of the fastest growing groups of homelesspeople, <span style=\"font-family: Georgia,serif;\">representing over 40% of the nation\u2019s homeless in 2009 according to the National Coalition for the<\/span>Homeless. In California, child homelessness is high. The National Center on FamilyHomelessness has given California a rank of 49<span style=\"font-size: 8.0pt;\">th <\/span>worst in the number of homeless children and 48<span style=\"font-size: 8.0pt;\">th <\/span>worst in the percentageofchildrenwhoarehomeless.<span style=\"font-size: 8.0pt;\">6 <\/span>AccordingtodatacollectedbytheMcKinney-Vento Educational Programs more than 527,000 California children experience homelessness last year in California. Of the 2,200,000 children living in poverty in California, thirteen percent are homeless.<span style=\"font-size: 8.0pt;\">7<\/span>Itshouldcomeasnosurprisethathomelessnessisincreasingamongfamilieswithchildren,as poverty among families with children is also on the rise.According to the Public Policy Institute of California, afterreachinga low of about 16%in 2001, the child poverty ratein California has been trending upward with nearly 1 in 4 children living in poverty in California (23.2%) in 2010.<span style=\"font-size: 8.0pt;\">8<\/span><\/p>\n<p><span style=\"font-size: 11pt; font-family: Cambria,serif;\">\u00a0<\/span><\/p>\n<h1 style=\"text-align: justify;\">Municipal Response to Homelessness Violates Rights and Entrenches Homelessness<\/h1>\n<p style=\"text-align: justify;\">In a report released by UC Berkeley School of Law, the large \u00a0majority \u00a0of \u00a0homeless \u00a0Californians resideincommunitieswhereitisnowillegaltorestinpublic.<span style=\"font-size: 8.0pt;\">9 <\/span>Withnoprivateplacetorest,these arelawswhichpeoplewhoarehomelesswillinevitablybreak.Restisanecessityoflifewhichno person,housedor unhoused,canavoid,andwhileit isnot acriminalact,agrowingnumber of municipal laws allow for a citation and \u00a0imprisonment \u00a0if \u00a0someone \u00a0is \u00a0found \u00a0to \u00a0be \u00a0resting. Homeless families are twiceaslikelyasmiddle-incomefamiliestoreportthattheirchildrenhavemoderateorsevere healthproblemssuchasasthma,dentalproblems,andemotionaldifficulties.<span style=\"font-size: 8.0pt;\">11<\/span>Manyofthese families and children have experienced trauma prior to becoming homeless, and homelessness can exacerbate the consequences of trauma or re-traumatize a child.<span style=\"font-size: 8.0pt;\">12 <\/span>Homeless children are sick four timesasoftenasmiddleclasschildrenandhavehighratesofacuteandchronicillnesses.In addition they suffer from emotional or behavioral problems that interfere with learning atalmost threetimestherateofotherchildren.Homelesschildrenbetween6and17yearsstrugglewith high rates of mental health problems with 47% experiencing anxiety, depression, or withdrawal, as compared to 18% of other school-age children. Homeless children get sick twice as often as other children.<span style=\"font-size: 8.0pt;\">13<\/span><\/p>\n<p><span style=\"font-size: 12.5pt; font-family: Cambria,serif;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">The health consequences of homelessness are not limited to children. On average, homeless adults have8to9concurrentmedicalillnesses,commonlysufferingfromskinconditions,respiratory infections, tooth decay, foot problems, vision disturbances, and trauma. Chronic diseases, suchas hypertension, diabetes, and asthma, are prevalent among people without homes and are more difficult to manage. We need this conversationatthestatewidelevel,somoreofthesuccessfulstrategiescanbeshared,andthe counterproductive ones avoided.<\/p>\n<p><span style=\"font-family: Cambria,serif;\">\u00a0<\/span><\/p>\n<h1 style=\"text-align: justify;\">SB 608\u2019s Protections for Homeless People Will Create Significant Savings<\/h1>\n<p style=\"text-align: justify;\">Thecurrentcostofenforcinglocallawsthatresultinthecitationandarrestofpeoplewhoare resting in public spaces in California costs these municipal governmentshundreds of millions of dollars. It includes the cost of law enforcement, jail, and court costs, <span style=\"font-size: 8.0pt;\">22 <\/span>as well as the human cost of homelesspeoplebeingdeprivedoflibertyandpunishedfornothavinghomesinwhichtorest. The cost of housing homeless people is less than the cost of jailing them, <span style=\"font-size: 8.0pt;\">23 <\/span>so there are opportunity costs as well: Rather than housing people, enforcement of resting laws creates criminal records that can bar homeless people from housing, jobs, and treatment.<span style=\"font-size: 8.0pt;\">24 <\/span>The savings wouldbe significant. California spends $849,396.44 per night on jailing homeless people, or $310,029,700 annually.<span style=\"font-size: 8.0pt;\">25 <\/span>Of the 1,388 respondents in a recent survey of people who are homeless, 78% had been cited for sitting or lying down,<span style=\"font-size: 8.0pt;\">26 <\/span>so the scope of enforcement is not small. SB 608 would stop cities from counterproductively enforcing laws against resting in public.<\/p>\n<p><span style=\"font-size: 8.5pt; font-family: Cambria,serif;\">\u00a0<\/span><\/p>\n<p><span style=\"font-size: 1pt;
